Conditions for postponement

Conditional release can be postponed with the consent of the prisoner if new imprisonment sentences or conversion sentences for unpaid fines are to be enforced or the prisoner wants postponement of conditional release for another justified reason. The postponement is decided by the prison director.

Conditional release can be postponed without the consent of the prisoner if, on the basis of the conduct of or threats made by the prisoner, there is an evident danger that on release he or she would commit an aggravated offence against life, health or freedom and postponement of the release is necessary in order to prevent the offence. In that case, the decision on the postponement is made by the Central Administration of the Criminal Sanctions Agency.

A prisoner has the right to appeal to the district court against a decision on the postponement of conditional release.
